Conditions of Entry: Definitions
1. The following definitions apply:
“ Agency ” means Legion Interactive Pty Ltd ABN 75 058 774 593
“ Approved Manner ” has the meaning set out in Clause 3.
“ Eligible Entrant ” means, subject to clauses 3 and 4, a person who has:
- applied in the Approved Manner for a new, or extension to an existing, NAB Home Loan of not less than $50,000.00 during the Promotion Period
- had that application approved by NAB during the Promotion Period, and who has
- partially or fully drawndown that NAB Home Loan within the Promotion Period.
Permanent employees and the immediate families of the Promoter, its subsidiaries, the Agency and the “Port Adelaide Football Club Limited” ABN 49 068 839 547 associated with this promotion are ineligible to enter.
“ NAB ” means National Australia Bank Limited ABN 12 004 044 937, Level 36, 500 Bourke Street, Melbourne, Victoria, 3000.
“ NAB Home Loan ” means any loan from the following home loans offered by NAB: National Base Variable Rate Home Loan, National Introductory Rate Home Loan, National Tailored Home Loan - Variable Rate, National Tailored Home Loan - Fixed Rate, FlexiPlus Mortgage, Rural Lifestyle Loan - FlexiPlus Mortgage, Rural Lifestyle Loan – Fixed Rate, Rural Lifestyle Loan – Variable Rate, Home Equity Line of Credit, NAB Portfolio Facility.
“ Promoter ” means NAB.
“ Promotion Period ” means the period from 12.01 am 1 May 2007 to 12.00 midnight, 9 September 2007.
Conditions of Entry
2. Information on how to enter and all prize details form part of the terms and conditions of entry (“Conditions of Entry”). By entering the promotion, entrants accept these Conditions of Entry.
Entry Eligibility
3. Entry is open to Eligible Entrants who are Australian residents and aged 18 years or over during the Promotion Period for the purposes of this competition, NAB Home Loan applications are made in the Approved Manner if they are made:
- via the dedicated telephone number 0414 443 745, or
- via www.nab.com.au/power, or
- online via the Port Adelaide Football Club website www.PortAdelaideFC.com.au or electronic newsletter, or which
- quote “Power” in their application.
Entry and Eligibility Restrictions/Allowances
4. Eligible Entrants will be automatically entered into the prize draw once their NAB Home Loan satisfying the eligibility criteria has been approved, subject to remaining qualifying criteria of partial or full draw down during the Promotion Period. Eligible Entrants are entitled to one entry into the prize draw for each loan satisfying the eligibility criteria during the Promotion Period. Eligible Entrants’ NAB Home Loan applications will be deemed to be approved when the NAB banker communicates verbal approval and issues a letter confirming approval to the particular applicant. If the NAB Home Loan has more than one applicant or borrower, the applicants and borrowers for each NAB Home Loan shall jointly be the entrant. The Promoter reserves the right to vary the rules of the competition or the prize offered or cancel the competition if it is no longer able to run it due to reasons beyond its control. The Promoter will not be liable for any losses to any party arising from any variation or cancellation.
Major Prize Draw
5. The prize draw will take place at 10.00 am (EST) on 11 September 2007 at Legion Interactive Pty Ltd ABN 75 058 774 593, Level 8, 155 George Street, Sydney NSW. One Prize Winner (“Prize Winner”) will be drawn randomly. The Judges’ decision is final and no correspondence will be entered into.
Prize Description & Values
Major Prize
6(a) Subject to these Conditions of Entry, the first valid entry drawn will win a 2007 Toyota AFL Grand Final package valued at $4,500 (includes GST). Each package includes: two return economy airfares from the winner’s nearest capital city to Melbourne; two tickets to the 2007 Toyota AFL Grand Final (General Admission) on Saturday 29 September 2007; two tickets to the Port Adelaide Football Club Grand Final Eve Dinner at the Sofitel Hotel, Melbourne and 2 nights twin share hotel accommodation. Meals, transport to and from and all other ancillary costs are the responsibility of the winner. The promoter accepts no responsibility for a variation in the value of the prize. Use of tickets won in this promotion are subject to all terms and conditions applicable to those tickets, and the Promoter is not liable or responsible for the Prize Winner’s compliance with such terms and conditions.
Minor Prize
6(b) The first 50 valid Eligible Entrants received will win a new season Reebok Power Home Guernsey signed by a Port Adelaide Football Club player, valued at $110 (includes GST).
Total prize pool is valued at $10,000 (includes GST).
Any Prize Restrictions
7. The prize is not transferable, divisible or exchangeable and, subject to a contrary arrangement with the Promoter, cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in the value or content of the prize.
8. The Promoter reserves the right to vary the rules of the competition or the prize offered or cancel the competition if it is no longer able to run it due to reasons beyond its control. The Promoter will not be liable for any losses to any party arising from any variation or cancellation.
Prize Substitution
9. Subject to these Conditions of Entry, if the Promoter is unable to provide the winner with the nominated prize or any part of the prize, for any reason, the Promoter reserves the right to supply an alternative prize of similar monetary value (subject to State/Territory Permit regulations).
Prize Winner Notification
10. The Prize Winner will be contacted either in writing, by telephone, email, or SMS by the Promoter (at the contact details held by the Promoter for the Eligible Entrant) within 2 business days of the draw:
(i) to notify the Prize Winner that he/she is a Prize Winner;
(ii) to confirm whether the Prize Winner is eligible to win under these Conditions of Entry; and
(iii) to confirm whether the Prize Winner wishes to claim his/her prize.
Details of the Prize Winner will be published in the public notices section of The Australian newspaper on 14 September 2007.
Confirmation of eligibility and claim of prize
11. The Prize Winner must confirm their eligibility under the Conditions of Entry and claim his/her prize within 10 days of being notified that he/she is a Prize Winner, provided that if the Prize Winner is a resident in the State of South Australia or the Australian Capital Territory at the date of the relevant prize draw, such Prize Winner may claim his/her Prize within 3.5 months of the draw.
Claim by date
12. If the Prize Winner (apart from a Prize Winner who was a resident of South Australia or the Australian Capital Territory (“ACT”) at the time of the draw) fails to comply with clause 11 or any other Condition of Entry affecting eligibility, the Prize Winner will be deemed to have forfeited his/her prize. If the prize/s are unclaimed, forfeited or the entrant does not meet the conditions of entry, the National reserves the right to a redraw on 24 September 2007 at the same time and place as the original draw, subject to permission from the Department of Gaming and Racing (NSW). Results of such further draw (if necessary) will be published in The Australian newspaper 26 September. A new Prize Winner receiving a reallocated prize will be notified as per the original Prize Winner’s notice method.
South Australian and Australian Capital Territory resident Prize Winners
13. If the Prize Winner is a resident of the State of South Australia or the Australian Capital Territory at the time of the draw and does not claim the Prize within 3.5 months of the prize draw, the Promoter will re-draw the prize on 28 December 2007 at the same time and place as the original draw. This is subject to any written direction given under Reg. 37 of the Lotteries and Gaming Act 1993 (SA). The winner of this draw (“the new Prize Winner”) will be notified in the method noted above of their prize, and will be awarded a prize subject to these Conditions of Entry. Details of the new Prize Winner will be published in the public notice section of The Australian newspaper on 4 January 2008.
Delayed/Misdirected Transactions
14. The Promoter accepts no responsibility for delayed or misdirected entries.
Miscellaneous
15 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any entrant’s or Prize Winner’s participation in the Promotion or the receipt or use of any part of a Prize except for any liability which cannot be excluded by law.
16 To the fullest extent permissible at law each Eligible Entrant and Prize Winner releases the Promoter from any claim, loss, damage, expense (including, without limitation any claim for legal expenses), cost and charge sustained and/or in any way incurred by them in connection with a prize and/or their participation in the Promotion.
17 The Promoter cannot provide advice on specific tax issues. The Promoter recommends that independent tax advice and legal advice on any tax implications arising from winning a Prize should be sought. In the event that any is subject to tax, the Promoter will not be liable for any additional tax payable by the Prize Winner.
18 By accepting a prize, the Prize Winner agrees to participate in any publicity arrangements made by or on behalf of the Promoter in relation to this Promotion. The Promoter reserves the right to publicise each Prize Winner’s name, suburb, date of win and photograph through newsletters, print media, electronic media, broadcasts or any other means of publicity.
19 The Promoter is not responsible for any incorrect or inaccurate information, either caused by website users or by any of the equipment or programming associated with or utilised in this competition, or by any technical error that may occur in the course of the administration of this competition. The Promoters assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

Promoters Use of Information
By entering this competition, the entrant consents to the Promoter collecting, using and disclosing to its agents and service providers the personal information included in the entry form for the purposes of conducting this competition and for future promotional, marketing and publicity purposes. The entrant may contact the Promoter to access or correct any personal information the Promoter holds about them. This is subject to some exceptions allowed by law.
